TERMS AND CONDITIONS
This End User License Agreement (“Agreement”) is a legal contract between you (the “User”) and Title Maps LLC (the “Owner”) defining the terms and conditions for use of the web site with URL http://titlemaps.com (the “Web Site”). The Web Site is owned and operated by the Owner, and by registering and using this Web Site, the User agrees to be bound by the terms of this Agreement. The terms and conditions of this Agreement are as follows:Payment. The User agrees to pay for the right to use the Web Site in accordance with the design and intended purpose. Upon payment and registration, the User will be able to create a user name and password to use for access to the contents of the Web Site. In connection with obtaining updated tax maps or as required by law, Owner reserves the right to impose a reasonable charge for printing tax maps or portions thereof. No such charge will be imposed until after notice of such charge is posted to the Web Site.
Ownership. The User agrees and acknowledges that the contents and information on the Web Site is and shall continue to be the exclusive property of the Owner. The Owner reserves all rights to copyrighted and copyrightable contents and information on the Web Site.
Limitations. The User agrees not to sell or transfer this Agreement to any other person, persons, company or companies. The User agrees not to reverse engineer, decompile or disassemble any content or information on the Web Site; this includes but is not limited to the software and code used to operate the Web Site. The User agrees not to copy or use any content or information on the Web Site except as explicitly permitted by the Agreement. The User agrees not to permit others to use the Web Site using their user name and password. The User agrees not to make any commercial use of the contents and information on the Web Site.
Permissions. The User is granted permission to use the contents and information on the Web Site for their exclusive use, including but not limited to printing listings of land book information, exporting land book information to a Microsoft Excel CSV file or other external file and printing maps. The User has unlimited access to the contents and information on the Web Site.
Disclaimer. The Owner has provided access to the contents and information on the Web Site to assist the User in the process of gathering information pertaining to real property in the state of West Virginia. The Web Site contains data and information from various sources including but not limited to state and federal agencies, and state and federal agency web sites. The tax map information was obtained in 2008 from the WV Department of Tax and Revenue and the User is advised that the tax maps may have been updated since 2008. The Owner is making every reasonable effort to obtain updated tax map information but Owner shall have no obligation to User to obtain such information. The map information does not represent and should not be relied upon as a land survey or legal depiction of the property or information shown. The Owner does not warrant the accuracy or correctness of the map information or the land assessment information on the Web Site. The contents and information on the Web Site is presented “as is” and the Owner does not make any warranties, express or implied, and User acknowledges and agrees that Owner is not liable for any damages that may occur as a result of User using the Web Site.
Termination. Either party may terminate this license at any time. The Owner reserves the right to stop offering services or to stop supporting the Web Site at any time. This Agreement will terminate immediately and without notice if the User fails to comply with any terms and conditions of this Agreement. This Agreement terminates immediately upon failure by the User to pay the required fees to access the Web Site.
User Privacy. The Owner will not share, disclose, sell, or in any way provide any User data to any person, company or entity.
Law Governing. This Agreement shall be governed by and construed in accordance with the laws of the State of West Virginia.
Signatures by Acceptance. By accessing the Web Site the User is agreeing to all terms and conditions delineated in this Agreement.
